The Supreme Court of Kosovo has falsely rejected the complaint of Blerim Isufaj, former chief prosecutor of Kosovo’s Special Prosecutor, against the Kosovo Prosecutorial Council ruling ( The KKP) for its departure from the leadership position.
The decision was made on October 27th, after the Supreme Court has considered whether the complaint met the legal conditions to be handled by this court.
The Supremei has estimated that the KKP’s decision to remove Isufaj from the leadership position is not a disciplinary decision, as disciplinary responsibility has not been filed against him. According to the Court, the verdict is an individual act of administrative character.
For this reason, the Supreme One has concluded that there is no legal basis for considering the complaint within its competence of disciplinary issues.
The court has made it known that the legality of the KPK ruling could be contested through the procedure of administrative conflict, before competent judges.
