In the media communiqué, the prosecution has indicated that on October 22nd, the chief prosecutor of this institution had accepted a request from the late Zekaj request, through which it had voiced concerns about dealing with previous cases and had called for implementation of a judicial order.
After accepting the request, the chief prosecutor has praised the circumstances presented and addressed the case to relevant institutions, including the Kosovo Police, the Constitutional Court in Pec, the Directorate for Labour and Social Management, the Centre for Social Work and the Office for Protection and Protection of Victims, said in the Prosecutor’s Community.
According to this institution, the case had also been initiated for the investigation of Zekiaj’s claims, with the aim of assessing whether the actions or inactions of official persons mentioned in the motion contained elements of the criminal act of misuse of official office or authority.
According to the prosecution, on October 16, 2026, the Court had issued a ruling under which Zekinaj’s former husband was ordered to allow him to return and exploit the common house. Also issued was protection order over a six – month period that had entered into force immediately.
The prosecution has stressed that, under the judicial decision, the tribunal’s order and announcement of its implementation or of the eventual obstacles were the responsibility of the Kosovo Police.
On the day Zekaj had requested implementation of the command and return to the common house, Kosovo police had announced the prosecutor’s custody of the case’s circumstances.
After assessing the situation and possible danger, the prosecutor had considered that the immediate return home could endanger her life and security. For this reason, according to the communiqué, she had been contacted by the victim’s brothers and had been asked to stay with her family members.
Despite the victim’s insistence on returning to the common house, the state prosecutor, given the circumstances presented and the possible danger, had instructed her to be sent to her brothers’ home, the communique said.
According to the prosecution, at Zekiaj’s own request, there was also a formal letter containing reasons for her decision to stay with family members. She had agreed to go to the brothers, but she had asked that the next day be accompanied by a police patrol to return to the common house.
Following the risk-level assessment, the prosecutor and police investigators had decided that a police patrol would stay near the house during its planned return.
The prosecution has indicated that, at 7:48 yesterday, Kosovo Police had contacted the caretaker prosecutor over a suspected family violence case that had occurred at Zekiaj’s house.
Her former husband, J.S., and the victim themselves were accompanied by the police station. In the case, procedure for the criminal offence of the court had been initiated, while the former husband had been detained for 48 hours.
During the case’s treatment, Zekiaj had been offered the opportunity to go to a shelter, but she had refused, seeking to return to the common house where her son and her wealth were located.
According to the communique, it was accompanied by a home police patrol around 9:00.
A few minutes after her return, the caretaker prosecutor had reportedly been hit with a strong tool inside the house by her brother-in-law, A.S., suspected in this case, says the Prosecutor’s Community.
After the announcement, relevant Kosovo Police units had emerged at the scene, chief prosecutor of the Constitutional Prosecutorship in Pec and Prosecutor-in-law of the Randa Crime Department to forward the situation and undertake initial investigative actions.
The prosecution has also announced that on October 23rd it has filed charges against Zekij’s former husband, J.S., for the crime of rowing within the family relationship.
In her response, the Constitutional Prosecutor in Pec has stressed that claims submitted by Zekij were seriously addressed and that actions were taken to address competent institutions, as well as to investigate possible responsibilities of official persons.
The programme expresses deep regret over the tragic loss of Arlinda Zekiaj’s life and expresses the most sincere condolences for her family, says the communique.
The institution has demanded that the case be thoroughly, objectively and professionally investigated, with the goal of clarifying all circumstances and assessing the eventual responsibilities of persons involved.
Meanwhile, according to the Prosecutor, Kosovo Police are taking action to locate and arrest suspect A.S., who has not yet been arrested.
