Director of the Kosovo Institute for Justice ( IKD, Ehat Miftaraj, has called attention to the Sebahate Morina case, which the Constitutional Court had concluded that police and Prosecution had failed to ensure the right to life.
Referring to the case of Arlinda Zekiaj, Miftaraj, invited to ıbat Plus in Dukagjin, said he has similarities to Morina’s case, occurring in 2021, and that institutions had to take measures to prevent the repetition of such cases.
It is the case of Sebahate Morina in 2021 that was almost identical, of course not to those sizes, but that it is true of the Constitutional Court that the Prosecutor’s Police have failed to ensure Sebahate Morina’s right to life, Miftaraj said.
He indicated that the IKD had sent Morina’s case to the Constitutional Court and investigated it. According to him, after publishing the indictment, expectations were for institutions responsible to take concrete steps to prevent similar cases.
) The IKD has sent the case to the Constitutional Court and has eaten its case, and when the indictment has come out in its case, the IKD has believed that all institutions, police, Prosecution, Court, QPS and others have taken proactive measures not to repeat such cases, he said.
Miftaraj stressed that institutions must apply the recommendations of the Constitutional Court, adding that the IKD has important information on how institutions have failed in the case of Arlinda Zekimaj.
What needs to be done is to follow up on the recommendations the Constitutional Court has made at Sebahate Morina’s decision. We have important information about where the state wanted the case of Arlinda Zekay. In either case, the state must ensure the protection of the family’s life and physical security of the victim of domestic violence. The state should not have been victim and ex-husband living in the same house, the judge would have to assess the danger, Miftaraj said.
