The Court of Appeals has annulled the sentence Muhammad Alidaj was sentenced to 13 years in prison for war crimes against the civilian population. The case is back in the retrial, while Alidaj will remain in custody until the first-instance court’s upcoming ruling.
The Special Appeals Department approved the prosecution and defence complaints, while the Constitutional Court Act in Pristina on February 2, 2026, cancelled it on official duty.
Why was the act of prejudice canceled?
Apel found that the Foundation, even during the retrial, had not corrected the shortcomings recorded in the previous decision. According to the college, the court did not explain what concrete actions Alidemaj had taken and what his contribution had been to doing the work in co-ordination.
According to Appeal, the Foundation had only praised the statements of three witnesses, leaving unappreciated other evidence administered in the trial. It had also given no excuse for evidence and defence claims. The appeal described these shortcomings as essential violations of the criminal procedure.
In the retrial, the Foundation must assess each evidence separately and in terms of other evidence, as well as reason on what facts it considers to be proved and on what evidence it is based.
With the sentence already cancelled, the Foundation had pronounced Alidemaj guilty of war crimes against the civilian population in co-ordination. In his 13 – year sentence, his time in custody was also estimated, beginning on March 30, 2021.
The defendant is declared innocent until his guiltyness is proven with a court of contempt.
