The Court of Appeals in Pristina has confirmed the indictment for corruption against Deputy Prime Minister Fikrim Damka and former Regional Development Ministry Secretary Besim Kamberaj’s taskman, seven months after the Constitutional Court had rejected him.
Damka and Camberaj are charged by the Special Prosecutor for misuse of office, after allegedly in the years 2021-2022 against the benefit of about one million euros to the organisations Carian Swiss and éGerminão.
According to the Court of Appeals’ announcement, the court has estimated that the first-degree decision to drop the procedure was in conflict with criminal procedure provisions. For this, Apel has arranged substantial violation of the procedure, according to Article 384 of the Criminal Procedure Code.
The court has also estimated that the evidence administered at this phase of the procedure creates well-based doubts that defendants have committed the criminal work they are accused of, as well as that evidence has been collected and secured in accordance with the law.
In March of this year, the Constitutional Court in Pristina had rejected the indictment, arguing that conditions for continuing criminal procedure had not been met due to lack of evidence.
After reviewing the complaint, Appeals has decided that the criminal procedure against Damka and Camberaj will continue in the phase of the trial review.
Damka is currently the third deputy prime minister in the Kurti 4ʹ, responsible for minority issues and co-operation.
