Abraham: The Law for the Bureau of Confiscating Riches is not yet available

Lawyer Adrian Ibrahimi has estimated that the Law for the State Bureau for Verification and Confiscating Unjustified Riches, adopted by the Assembly of Kosovo after the second review, is still not ready to enter into force in the current form.

Abraham, invited to é IN Dukagjin, the Constitutional Court has said this time the Constitutional Court should review not only the adoption procedure but also the content of the provisions of the law.

The last step when it has been brought back by the Constitutional Court, the reasonableness of the Constitutional Court’s decision has been manifested in the sense of approval procedure, and the DK has not been issued in a merit review of the content of the provisions of this law. I think this time it’s time for the Constitutional Court to deal with it in terms of the contents of the provisions and merits of this law, Ibrahim has declared.

He has stressed that Kosovo will probably pass into the system of civil seizures of property, but according to him, this system should be built fairly and fairly, given the experiences of states that have successfully implemented it.

As far as the law is concerned, we have sometimes said that Kosovo has a good opportunity to pass into the civil seizure system, but the civil seizure system must be done fairly and fairly, as other states have successfully implemented this system, such as Italy, England, Bulgaria and Ireland, have said.

Ibrahim has also raised concerns about the content of the law, assessing that, although he differs from previous drafts, there is still uncertainty that could cause problems during implementation.

If we analyze the content of the law, this law has a difference from earlier drafts, but I think it’s still not ready to enter into force in the form that was adopted, the lawyer has declared.

One of the dilemmas he has set up relates to the parallel existence of the current system of seizures of property and the new system of civil seizures.

He has explained that the Law for Expanded Compensations on the Confisciency of Riches gives justice to the State Prosecutor who, up to five years after a decision of a firm form for a person’s guilty plea, to initiate procedure for the seizure of property he allegedly benefited from through the criminal act for which he was convicted.

This law aimed at implementing the civil seizure system does not abolish the current seizure system in transitional provisions. The challenges that may arise in practice are to initiate seizure procedures both under the old law, and according to this law, Abraham stressed.
