KEK was sentenced to 2 years in prison for misuse of office, but Appeals returns sentence to Ymer Dragusha even the Special Prosecution request softer sentences

Kosovo’s Appeals Court has changed the sentence to Ymer Dragusha, who was sentenced by the Constitutional Court in Pristina to two years in effective prison for misusing official office or authority.

Under the conviction provided by the Signal newspaper, Appeals has decided that the two-year prison sentence will be conditional, meaning that he will not serve the sentence unless he commits another criminal offence within the two-year period of verification.

The decision was made on 29 September 2026 by the college comprised of judges Ferit Osmani, chairman Avni Mehmeti and Albina Shabani-Rama, members.

What stands out is that against the effective prison sentence the Special Prosecutor of the Republic of Kosovo himself had filed complaints in favour of the accused.

Dragusha, who had been acting as director of the Procurement Office, was found guilty of four criminal acts of abuse of official office or authority in connection with actions undertaken during the 19202,2023 ‘ s.

The Constitutional Court in Pristina, on July 27, 2026, had sentenced him to two years in effective prison terms, though there was agreement between him and the Special Prosecution, under which parole had been recommended.

On the other hand, the Special Prosecutor had demanded that the court be changed and Dragusha be pronounced paroled, or that the case be returned to restoration.

Dragusha had agreed to co-operate with the Prosecutor in the quality of the co-operative witness in the criminal procedure against the other two indictees.

According to Apel’s reasoning, the first-degree court had committed violations during the sentence, having approved the plea agreement but later pronounced effective imprisonment without providing sufficient rationale for such a decision.

The appeal has also found that the four actions Dragusha was convicted of should be treated legally as an ongoing criminal offence, not as four separate acts.

Eventually, the Court of Appeals has changed the judgment to part of the legal selection and condemnation, leaving the rest of the decision unchanged.
